Telephone Advice Terms & Conditions


Terms and Conditions for Telephone Advice Sessions

This page sets out details of our terms and conditions for use of our telephone advice service. Please read this information carefully before proceeding to request a telephone advice session.

1. The person giving advice

Advice during the session is provided by Rosamund Evans or a trained member of our team.

2. Plus and Plus One membership

Use of our telephone advice service gives you the opportunity to join our BE My Own Lawyer membership service. You will be sent a link to enable you to take up this offer when you have received your telephone advice session.

3. Telephone advice service

Important information – please read.

3.1 The advice will be given in one telephone call only.

3.2 Call charges will be at your expense – you call us at an agreed time.

3.3 The call is to take place at a mutually convenient pre-arranged date and time.

3.4 If the problem is too complex to be dealt with fully in one telephone call you will be informed and invited to request a quotation for further assistance, if appropriate.

4. Fees

4.1 We reserve the right to alter the fixed fee charges for the telephone advice service from the amount currently shown on our website. Any changes to fees for the service will only affect clients who request a telephone advice session after the fee changes have been implemented.

4.2 Payment for a telephone advice session must be made in full when booking the session by one of the accepted payment methods. An invoice will be supplied to the client making the booking prior to the session taking place. We reserve the right to withdraw from a telephone advice session where payment in full has not been made.

4.3 Where payment is made by cheque at least 5 working days will be required for clearance of the cheque before a telephone advice session takes place.

5. Cancellation

You have the right to cancel your instructions under the Consumer Contracts Regulations for up to 14 days after you place your order, provided the telephone advice session has not yet taken place. Your order cannot be cancelled after the telephone call has taken place.

6. Regulation

Rosamund Evans is a qualified solicitor regulated by the Solicitors Regulation Authority and Barker Evans Private Client Law is a solicitors practice authorised and regulated by the Solicitors Regulation Authority SRA number 498553. Our legal services are covered by professional indemnity insurance up to a limit of £2,000,000. More information can be obtained from www.sra.org/code-of-conduct.

7. Standards of Service

7.1 We will provide our services with reasonable skill and care and subject to exclusions and limitations contained in our terms and conditions we will be liable for losses caused by our wilful default. Our responsibilities will only extend to advice and services you have actually instructed us to supply.

7.2 It is your responsibility to provide us with accurate and complete information and documentation. If you decide to instruct us you will be bound by our standard terms and conditions as well as these specific terms and conditions unless we expressly exclude them.

7.3 All discussions and information supplied are treated in the strictest confidence. We do not disclose clients’ contact details to any third parties. We may use client contact details to supply information and marketing materials that we think may be of interest from time to time. If you do not wish to receive such information and material from us you may unsubscribe at any time by sending an email to enquiries@barkerevanslaw.co.uk  headed ‘unsubscribe’.

Your statutory rights are unaffected.
